My name is Alan Weintraub

I graduated in the top 5% of my class at George Washington University Law School and earned a Master of Laws from New York University Law School. I have been practicing law for over 40 years, with experience at top firms like A&O Shearman and JPMorgan Chase. Today, my focus is solely on helping individuals and families navigate the U.S. Court of Federal Claims’ Vaccine Program. This work is personal to me — my own family has been through the vaccine court process — and I understand both the legal and emotional challenges it can bring. My goal is to guide you through every step with skill, compassion, and dedication.

Do I pay attorney’s fees?

No. If we take your case, our fees are paid directly by the Program.

 

Do you represent clients outside my state?
Yes — NVICP is federal, and we represent clients nationwide.

How long does a case take?

Most cases resolve in 12–36 months, depending on complexity.

How long do I have to file a vaccine injury claim?
Under the Vaccine Injury Compensation Program, there are strict deadlines (statutes of limitations) for filing a claim:

  • For injury cases: You must file within 3 years from the first symptom of the injury.

  • For death cases: You must file within 2 years of the death and within 4 years after the first symptom of the vaccine-related injury that resulted in death.

Is there a maximum VICP payout?
There’s no single maximum. Pain and suffering is capped at $250,000, but medical care and lost earnings aren’t capped, so total compensation can be higher. In a death case, the statute provides a $250,000 death benefit. Attorneys’ fees and costs may be paid separately by the Program if approved by the Court.

 

How are payout amounts decided?
A court Special Master reviews medical records and evidence (e.g., life-care plan, impact on work) and decides eligibility and the type/amount of compensation. Many cases resolve by settlement. Punitive damages aren’t available in VICP.
